A positive decision was reached in favor of FIFA and UEFA in the case of reference to European Competition Law.

European competition law is not violated if FIFA and UEFA exclude teams and players participating in the European Premier League from their respective competition series – the European Court of Justice’s chief advisor concluded in his application published on Thursday. This does not yet mean a final decision, but in practice the General Counsel’s proposal is accepted by the subsequent decision of the EU Court.

Writing in his opinion on the issue, which was made public Thursday, Senior Adviser Athanasios Rantos wrote:

  • FIFA and UEFA rules, which oblige all new competition series to be created with their prior permission, comply with European Union law.
  • UEFA’s competition rules do not prohibit FIFA and UEFA, their member associations or their national associations, from threatening sanctions against clubs belonging to those confederations if they engage in a project to create a new competition that would risk undermining the legitimate objectives of FIFA and UEFA.
  • The UEFA competition rules do not conflict with the rules for the exclusive distribution of rights relating to competitions organized by FIFA and UEFA contained in the FIFA Statutes, if such restrictions are organically linked to the achievement of legitimate objectives relating to the specifics of the sport and are proportionate to those objectives.
  • FIFA and UEFA statutes, which require the establishment of a new pan-European football competition between clubs for a prior authorization system, do not conflict with EU law.
